These Terms of Service ("Terms") form the agreement between BedsBooking ("we", "us") and you ("Customer", "you") for the use of the website bedsbooking.com and the BedsBooking platform ("Services"). By using the Services you agree to these Terms. If you have signed a separate subscription agreement or order form, that document prevails in case of conflict.
1. Eligibility and account
The Services are intended for businesses and professional use. You confirm that you are authorised to act for the property you register. You must provide accurate information, keep your login credentials confidential and are responsible for all activity under your account and the users you invite.
2. Subscription, fees and payment
Fees are stated in our published plans or your order form, exclusive of VAT and other taxes, and are billed in advance monthly or annually. Invoices are due within 15 days. We may suspend the Services if payment is overdue after reminder. We may change prices with at least 30 days' notice; changes apply from your next billing period.
3. Free trial
We may offer a free trial. Trials may be limited in features or time and may be ended by us at any time. Data created during a trial is deleted 30 days after the trial ends unless you subscribe.
4. Your data
You retain all rights to the data you enter into the Services, including guest and booking data. You grant us a licence to host, process and back up this data solely to provide the Services. For guest data you are the data controller and we act as data processor under our Data Processing Agreement; you are responsible for having a lawful basis to collect and share guest data with us.
5. Acceptable use
You must not use the Services for unlawful purposes, upload malicious code, attempt to gain unauthorised access, reverse engineer the platform, overload our systems, or resell the Services without our written permission.
6. Third-party channels and integrations
Connections to online travel agencies, payment providers and other third-party services are subject to those providers' own terms. We are not responsible for their availability, fees or actions, and you remain responsible for the accuracy of rates and availability you publish through them.
7. Availability and support
We aim for 99.9% monthly availability excluding scheduled maintenance, which we announce in advance where possible. Support is provided by email and chat during our published support hours. We do not guarantee that the Services will be uninterrupted or error-free.
8. Intellectual property
The platform, software, design and documentation are owned by BedsBooking or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Services during your subscription. Any feedback you provide may be used by us without restriction.
9. Warranties and limitation of liability
The Services are provided "as is". To the fullest extent permitted by law, we exclude all implied warranties. Our total liability for any claim arising from the Services is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect, consequential or special damages, loss of profit, revenue or data, except where such liability cannot be excluded under Thai law.
10. Term and termination
Subscriptions renew automatically for the same period unless cancelled before the renewal date. You may cancel at any time from your account or by email; cancellation takes effect at the end of the current billing period and fees already paid are not refunded. We may terminate for material breach that is not remedied within 14 days of notice. After termination you have 30 days to export your data, after which it is deleted.
11. Governing law
These Terms are governed by the laws of the Kingdom of Thailand. Disputes are subject to the exclusive jurisdiction of the courts of Thailand. If there is a conflict between the Thai and English versions, the Thai version prevails for customers in Thailand.
12. Changes and contact
We may update these Terms. Material changes will be notified by email or in the platform at least 30 days before they take effect. Continued use after that date constitutes acceptance. Contact: [email protected].
